These Terms of Service ("Terms") govern your access to and use of the Unsaid mobile application, website, and related services (collectively, the "Service") operated by Unsaid ("we," "us," or "our").
By creating an account, accessing, or using the Service, you agree to be legally bound by these Terms. If you do not agree, do not use the Service.
1. Description of Service
Unsaid is an AI-powered journaling and self-reflection platform that generates prompts and responses using artificial intelligence.
The Service is provided for informational and personal reflection purposes only.
Unsaid does not provide medical advice, psychiatric diagnosis, therapy, counseling, crisis intervention, or any form of licensed healthcare services.
2. No Professional Relationship
Use of the Service does not establish a therapist-client, doctor-patient, fiduciary, confidential, or professional healthcare relationship between you and Unsaid, its owners, employees, affiliates, contractors, or developers.
AI-generated responses are automated outputs and may be incomplete, inaccurate, or inappropriate for your circumstances.
You acknowledge that you are solely responsible for evaluating any information provided.
3. Not a Substitute for Professional Care
Unsaid is not a replacement for licensed medical, psychological, or psychiatric care.
If you are experiencing suicidal thoughts, self-harm urges, emotional crisis, or severe mental health symptoms, seek immediate professional help.
If you are in the United States, call or text 988 to reach the Suicide & Crisis Lifeline.
If you are in immediate danger, call 911 or your local emergency number.
You agree that you will not rely on the Service as your sole source of mental health support.
4. User Responsibility
You agree that:
- You are solely responsible for your mental health decisions and actions.
- You assume full responsibility for your use of the Service.
- You will seek licensed professional care when appropriate.
- You understand that AI-generated content may be imperfect or incorrect.
5. Eligibility
You must be at least 13 years old, or the minimum age required in your jurisdiction, to use the Service.
If you are under 18, you represent that you have parental or legal guardian consent.
We reserve the right to suspend accounts that violate age requirements.
6. User Content
You retain ownership of content you submit ("User Content").
By submitting content, you grant Unsaid a limited, non-exclusive, worldwide license to store, process, and display such content solely for operating and improving the Service.
You are solely responsible for your User Content and agree not to upload unlawful, abusive, harmful, or illegal material.
7. Privacy
Your use of the Service is also governed by our Privacy Policy.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."
TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNSAID DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR RELIABILITY OF AI OUTPUT
We do not guarantee uninterrupted or error-free service.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNSAID, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
THIS INCLUDES DAMAGES ARISING FROM:
- RELIANCE ON AI-GENERATED CONTENT
- EMOTIONAL OR PSYCHOLOGICAL OUTCOMES
- LOSS OF DATA
- BUSINESS INTERRUPTION
- PERSONAL INJURY
- ANY DECISION MADE BASED ON THE SERVICE
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) $100 USD OR (B) THE AMOUNT YOU PAID TO UNSAID IN THE LAST 12 MONTHS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
10. Indemnification
You agree to indemnify, defend, and hold harmless Unsaid and its affiliates from any claims, damages, liabilities, losses, or expenses, including attorneys' fees, arising out of:
- Your use of the Service
- Your violation of these Terms
- Your User Content
- Your violation of any law or third-party rights
11. Subscriptions & Payments
Unsaid Premium is offered as an auto-renewable subscription through Apple. The price, subscription period, and any free-trial eligibility are displayed in Apple's purchase confirmation sheet before you subscribe.
- Payment is charged to your Apple Account when you confirm the purchase.
- The subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.
- You can manage or cancel your subscription in your Apple Account subscription settings.
- You can restore an eligible purchase from within the app.
- Refund requests are handled by Apple and are subject to Apple's policies and applicable law.
12. Termination
We may suspend or terminate your access at any time if you violate these Terms. You may delete your account at any time through Settings.
13. Arbitration Agreement
PLEASE READ THIS SECTION CAREFULLY.
You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively through binding arbitration.
Arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
The arbitration shall take place in Maricopa County, Arizona, unless otherwise required by law.
Judgment on the arbitration award may be entered in any court of competent jurisdiction. You waive the right to a trial by jury.
14. Class Action Waiver
YOU AGREE THAT ANY CLAIMS SHALL BE BROUGHT IN YOUR INDIVIDUAL CAPACITY ONLY.
YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING AGAINST UNSAID.
15. Governing Law
These Terms shall be governed by the laws of the State of Arizona, without regard to conflict of law principles.
16. Changes to Terms
We may update these Terms at any time. Continued use of the Service after updates constitutes acceptance of the revised Terms.
